The terms and conditions below describe what you are legally entitled to expect from us after fulfilling your obligations as a Client. Please go through our terms and conditions carefully before booking with us. These terms constitute a binding agreement between the Client and African Eco Tours at all times.
1. Our company being a travel agency, we sell a variety of travel related services from different service providers of which each service provider has their own terms and conditions that may be applicable to your travel arrangements in addition to our terms and conditions. Please endeavor to go through other service providers’ terms for we shall not be held liable for their failure to fulfill their obligations whether in relation to travel arrangements, accommodation or otherwise. The terms in use by such service providers which are often constituted on the ticket issued by the service provider, shall constitute the sole contract between the service provider and the client and any right of recourse the Client may have, will be solely against such service providers.
2. You are required to make a deposit payment of 50% for any travel service that you would like to purchase from us. This will enable us to hold a reservation for you with other corresponding service providers but does not guarantee the price of the entire package until full payment is made. Prices can only be guaranteed once we receive full payments.
3. Clients intending to go for gorilla tracking will be required to pay the full price for gorilla tracking permit on top of the 50% deposit paid. Tracking permits must be booked in advance since they are on a very high demand all year round.
4. The full amount payable by the Client to African Eco Tours shall be fully paid prior to commencing any safari.
5. In case of increased costs from other service providers and increased operational costs (such as changes in the cost of fuel, park entry/ game reserve fees, volatile exchange rates etc.) after payments have been made, we shall pass on such related costs to you as soon as we become aware of them.
6. Clients who seek to partake in activities outside the arranged package will be charged an extra cost on top of the entire payment.
7. We reserve the right to refuse cheques as a method of payment. Payments for any service should be made in cash or by wire transfer into our bank accounts Cash will only be handled in exceptional circumstances for instance when making payments for extra costs. You are entirely responsible for bank charges resulting from depositing money on the company account.
8. With the exception of general receipts obtained after making payments, our practice is to send documents to Clients electronically. We therefore reserve the right to charge an administration fee of $5 should a Client request for a hard copy.
9. We reserve the right to amend bookings if need be provided the itinerary and price is not substantially different from the itinerary that the Client anticipated enjoying. We shall make sure that you are promptly notified of any changes once we become aware of them and alternatives given in terms of different arrangements and or travel dates. We therefore accept no liabilities for any changes or costs incurred that may result after amending a booking and the Client shall not be entitled to cancel the contract.
10. For where a Client wishes to amend his/ her booking at any stage, either in the form of a date change, itinerary amendment or any other change whatsoever, we reserve the right to charge an amendment fee per booking. One itinerary amendment is free, thereafter each change being charged at $50 per booking, over and above the tour cost.
11. All reservation changes are subject to availability and terms of the service provider.
12. Changes to name details are not allowed by many service providers. While we may accept such changes, please bear in mind that most service providers treat a name change as a cancellation, to which standard conditions and charges may apply.
13. Should the group number fall below the minimum number required for a travel package as specified in the booking confirmation, we reserve the right to re-cost the fare and raise a surcharge. Should any Client refuse to accept and pay such surcharges, we also reserve the right to cancel the tour and retain full payment.
14. If you decide to cancel your travel arrangements before completing the entire payment and or prior to commencement of the safari, any deposits paid will not be refunded.
15. We reserve the right to cancel bookings if need be. Cancellation ensuing from our side warrants a full refund of all the amounts received from Clients with no further claim of any nature whatsoever.
16. Should a Client fail to take a tour, or fail to use the accommodation/ services booked by African Eco Tours on their behalf, for any reason whatsoever, no refund or liability will be accepted by the company.
17. No refunds will be considered in any circumstances whatsoever after commencement of a tour, although the company may, in its sole discretion, upon proof, consider a refund in the event of death or serious illness of the Client prior to commencement of the tour.
18. You are advised to purchase comprehensive travel insurance which should cover your medical expenses and emergency evacuation if required, theft or damage of baggage and personal effects, trip cancellation and unforeseen eventualities resulting from natural calamities. It is the Client’s sole responsibility to arrange such insurance, either through us or your brokers. We shall not be held liable in case of any loss, damage, injury or death which a Client may suffer as a result of not having such insurance.
19. It is solely the Client’s responsibility to be in possession of the necessary travel documents such as passport, visa and health certificates/ vaccination cards in respect of the proposed itinerary. You should confirm these with the relevant embassies and/ or consulates in your respective countries. We do not accept any responsibility in the case a Client is unable to travel due to not complying with any such requirements.
20. You are entirely responsible for your travel documents and so you should keep them safely at all times.
21. It is envisaged that the contract may include visiting areas where Clients could be exposed to danger for which you have agreed to execute a waiver of rights against African Eco Tours, its principals and others as an integral part of these terms. The Client who shall be deemed to include; the heirs, executors, administrators or assigns of the Client does hereby irrevocably waive and abandon all and whatsoever rights which the Client may have against African Eco Tours, in consequence of any loss, damage, injury, death or otherwise of whatsoever nature and howsoever arising which may be sustained directly or indirectly by the Client in consequence of any act of omission or commission by African Eco Tours or others in consequence of the conclusion of the contract and the client undertaking the tour/ journey contemplated in the contract. In no way derogating from the foregoing, the Client hereby indemnifies, holds harmless and absolves African Eco Tours, its principals or others, from all and whatsoever claims which may be tenable by the client as aforesaid, irrespective of the nature thereof and howsoever arising.
22. African Eco Tours will under no circumstances be liable for any claim whatsoever, unless such a claim is due to the gross negligence of the company and such claim is lodged in writing with African Eco Tours within 14 days after the end of the tour. Such liability will be subject to a limitation of $8,00 per Client and under no circumstances will African Eco Tours be liable for any indirect or consequential loss or damage.
23. By booking with us, you signify acceptance, and agree to be bound by the terms and conditions listed above. You also agree on behalf of those that you are representing to comply with all terms and conditions as listed above including the payment of all amounts when due (Payments due by the Client will incur interest from the due date at a rate 2% above the prime rate charged by the bank). On the contrary, violation of any such terms and conditions may result in;
- Cancellation of your reservation or purchase.
- Forfeiture of any monies paid for your reservation or purchase.
- Being denied access to the applicable travel service.
- Our right to debit your account for any costs we incur as a result of such violation.
- Filling a legal suit
24. In the event of any legal challenge, the Client will be liable for all legal fees on an attorney and own client scale in the event that African Eco Tours has to engage a lawyer to enforce any of its rights or otherwise.
25. Terms and Conditions under this agreement are subject to the Jurisdiction of Ugandan laws.
26. These terms constitute the entire terms of the relationship between the Client and African Eco Tours. There exists no other terms, conditions, warranties, representations, guarantees, promises, undertaking or inducements of any nature whatsoever regulating the relationship, and the Client acknowledges that he/she has not relied on any matter or thing stated on behalf of African Eco Tours or otherwise that is not included herein.
